Weingarten Rights
  • According to this court ruling an employee is
    entitled to have a representative of his/her
    choice present at any meeting that he/she
    reasonably believes may be disciplinary in nature.

Weingarten Rights
  • If a supervisor refuses to honor the employees
    request for representation, he/she commits an
    unfair labor practice and the results of the
    meeting may be set aside.

Notice of Weingarten Rights
  • It is a managers responsibility, when calling a
    disciplinary (or potentially disciplinary)
    meeting, to inform the employee of his/her right
    to representation.

Things to Remember
  • If the purpose of the meeting is disciplinary,
    you must inform the employee (part-time or
    full-time) that he/she has a right to
    representation.
  • If a non-disciplinary meeting becomes a potential
    disciplinary meeting, stop the meeting and inform
    the employee of their representation rights.
