3Behavioral Conference
- When a student has been documented for a possible
violation, they are contacted by the Area
Coordinator in their living area to attend a
Behavioral Conference.

4Accountability Hearing
- Once the case is received by CSC, the staff will
begin to schedule the hearing on the docket.

- When a student denies violating the policy(s) as
documented, the Hearing Officer (AC/RC) of their
living area refers the case to the Office of
Community Standards and Civility (CSC).
5Types of Hearing Boards
- There are two types of Hearing Boards in the
University of Daytons Process - Student Hearing Board
- Composed of five undergraduate students who have
been trained in both the policies and procedures
of the student judicial process. - This type of board cannot hear cases that may
lead to suspension from the university. - University Hearing Board
- Also made up of five members.
- Consists of three students, and two faculty or
staff members of the university.
Both boards are chaired by a student member.
6Scheduling the Hearing Board
- First, the students academic schedule is checked
to see what days and time work best for the
student. - Next, the board is chosen based on the
pre-determined hearing board docket.

The date of the hearing is chosen. In cases that
are not serious enough to involve suspension, it
is preferred that the case is heard by the
Student Hearing Board. However, to ease the
scheduling process, these cases can be heard by
the University Hearing Board if the students
schedule fits best for that board.
9Notice of Accountability Hearing
- Once the hearing date is set, CSC sends out a
Notice of Accountability Hearing to the accused
student. This notice is sent both electronically
and by mail. - The Notice of Original Hearing includes
- The date and time of the hearing.
- Where the hearing is located.
- Contact information for questions.

- The hearing boards meet in Gosiger Hall and use a
round table format as seen below

11Hearing Board Format(Step-by-step)
- The Hearing Board Chair (HBC) will call the
hearing to order and clarify the purpose of the
hearing. - The HBC will ask the police officer, staff
member, or other person who filed the complaint
to state the charges and provide information
about the incident.
12Hearing Board Format
- The HBC will allow hearing board members and the
accused to ask questions of the officer or staff
member.
Your Story
- The HBC will ask the accused student to respond
to the charges filed against them.
13Hearing Board Format
- The HBC will ask the accused student to call
witnesses.
- The HBC will ask the accused student to have each
witness state their name for the record and
convey the information pertinent to the hearing.
14Hearing Board Format
- The HBC will offer all participants the
opportunity to ask each witness questions.
- After all witnesses have appeared before the
board, both parties will be asked to make their
closing remarks. In an Accountability Hearing
the student will be able to make their remarks
last.
15Executive Session
- After both parties have made their closing
remarks, the HBC will close the hearing and the
board members will go into Executive Session.
This session is closed to the accused and the
police/staff that filed the charges. - Once the board decides what more likely than not
occurred, they will either dismiss the charges
or sanction the student for a violation.
16Preparing for Your Hearing
- Make a list of bullet points that you want to be
sure to cover when you respond to the charges. - It is best to just tell your story but the list
will help you to have something to look back at
to be sure you didnt forget anything important.
- I was walking with friends back from my sisters
house on Lowe's. - There were guys walking in front of us who turned
around and started yelling at us. - We turned to go down the ally.
- They followed and one guy threw a can at us.
- I turned and told them to quit it.
- One of the guys started running for us and my
friends took off. - He charged at me and I hit him to protect myself.
17Preparing for Your Hearing
- Talk to the witnesses you know
- Make sure if you plan to call them as witnesses
that they are able to attend at the scheduled
hearing time and that they know where to go. - Go over with them what you have been charged
with so that they can prepare themselves by
recalling the events and sharing their story.
18Preparing for Your Hearing
- You are allowed to have a support person join you
in the hearing - Spend some time thinking about who that might be
so that you can contact them in time for them to
plan ahead. - It is important to note that your support person
is not permitted to speak in the hearing, except
directly to you. Often this person serves you
best when they are able to see your notes so that
they can point out things that you may have
missed. - Also, they are good at helping you if they feel
- you have gone off track.
19Preparing for Your Hearing
- Many students find it helpful to write out their
closing comments and read it to the board. This
has been particularly true for students who may
be facing suspension.
