What is Workers Compensation?
  • A state-regulated insurance program
  • that pays medical bills (medical benefits) and
  • some lost wages (income benefits) for
  • employees with work-related (compensable)
  • illnesses and injuries-regardless of fault.
  • Not mandatory except for political subdivisions
  • Examples School districts, counties, state
    government

  • (a)  An employee who sustains a compensable
    injury is entitled to all health care reasonably
    required by the nature of the injury as and when
    needed. The employee is specifically entitled to

  • Requested by the carrier to evaluate the
    employees medical condition after a DD

  • Peer Review / Utilization Review Doctor (URA)
  • Performs an administrative review of the health
    care of a workers' compensation claim at the
    insurance carrier's request.

    receiving (408.0043).

  • If no Employer's First Report of Injury has been
    filed, any other communication regardless of
    source, which fairly informs the carrier of the
    name of the injured employee, the identity of the
    employer, the approximate date of the injury and
    information which asserts the injury is work
    related.

    of injury

    the claimant of a denial of a claim (Denial)
    based on non-compensability or lack of coverage
    in accordance with this section and as otherwise
    provided by this title.

  • (l) The carrier shall not withdraw a
    preauthorization or concurrent review approval
    once issued. The approval shall include
  • the specific health care
  • (2) the approved number of health care treatments
    and specific period of time to complete the
    treatments and

    the denial of compensability or liability or an
    unresolved dispute of extent of or relatedness to
    the compensable injury.

Prohibition Against Billing the Injured
Employee413.042 133.20
  • A health care provider may not pursue a private
    claim against a workers' compensation claimant
    for all or part of the cost of a health care
    service provided to the claimant by the provider
    unless
  • the injury is finally adjudicated not
    compensable or
  • the employee violates the law regarding the
    selection of a doctor and the doctor did not know
    of the violation at the time the services were
    rendered.
  • 413.042. PRIVATE CLAIMS ADMINISTRATIVE
    VIOLATION.

If the Employer wants to Pay133.20
  • The doctor may decide to accept payment of
    medical bills from the covered employer, however,
    the doctor waives the rights to
  • Prompt payment,
  • Interest for delayed payment, and
  • Division-provided medical dispute resolution.
  • The doctor is still required to submit a copy of
    each bill to the carrier.

  • A medical bill must be submitted within 95 days
    unless

  • Exceptions to the 95 day deadline
  • 408.0272 CERTAIN EXCEPTIONS FOR UNTIMELY
    SUBMISSION OF CLAIM
  • (1)  the provider submits proof satisfactory to
    the commissioner that the provider, within the
    period prescribed by Section 408.027(a),
    erroneously filed for reimbursement with
  • (A)  an insurer that issues a policy of group
    accident and health insurance under which the
    injured employee is a covered insured
  • (B)  a health maintenance organization that
    issues an evidence of coverage under which the
    injured employee is a covered enrollee or
  • (C)  a workers' compensation insurance carrier
    other than the insurance carrier liable for the
    payment of benefits under this title or
  • (2)  the commissioner determines that the failure
    resulted from a catastrophic event that
    substantially interfered with the normal business
    operations of the provider.
