  • 2008 DW Regulations Package 1
  • 10 Subchapters of 401 KAR Chapter 8 were revised
    to delete all state language that was directly
    related to federal regulatory language
  • Also picked up Stage 2, LT2 and the GWR
  • Refers to 40 CFR Parts 141 (SDWA regulations),
    142 (State Primacy) and 141 (Secondary
    Contaminants)
  • Should be final the first week in April

  • Primacy
  • being first in time, rank, order etc supremacy
  • Primary Enforcement Responsibility
  • primary responsibility for administration and
    enforcement of primary drinking water regulations
    (40 CFR Part 141) and related requirements
    applicable to public water systems within a State

Primacy for the SDWA
  • Currently KY has either interim primacy or is
    working on initial primacy packages
  • With the complete 401 KAR Chapter 8 revisions,
    primacy packages have to be re-submitted!
  • Involves a crosswalk that compares the federal
    language in Part 141 with comparable state
    language
  • 40 CFR Part 142 has the language and requirements
    that fall on states to obtain and maintain
    primacy
  • Basically how the state program is run
