    orders would not be accepted as a defense.
    Similarly, in the former Yugoslavia, the Security
    Council and various individual states repeatedly
    warned combatants that those committing
    atrocities would eventually be prosecuted. But
    there is no empirical evidence of effective
    deterrence in either case.
