MEL 1999 (5) Guiding Principles
  • Provide care under conditions of appropriate
    security with due regard for public safety
  • Have regard to quality of care and proper
    attention to the needs of individuals
  • Where possible provide care in the community
    rather than institutional settings
  • Provide care that maximises rehabilitation and
    the individuals chance of an independent life

  • a Managed Care Network
  • Review the process for determining the right care
    for mentally disordered offenders.
  • Develop protocols to support the transfer of
    patients between the different levels of service
    and accommodation.

Mental Health (Care Treatment) (Scotland) Act
  • Under the new Mental Health Act, a right of
    appeal will be introduced no later then May 2006
    for patients who consider themselves to be
    subject to conditions of excessive security and
    these appeals will be considered by the Mental
    Health Tribunal
