Power to Make Treaties
  • A treaty is an agreement between two sovereign
    states.
  • Once the President has signed a treaty it must be
    approved by 2/3 vote of the Senate.
  • The Senate always approves treaties.

Executive Agreements
  • An executive agreement is a pact made between the
    President and the head of another state.
  • The President can make these without the consent
    of the Senate.

Power of Recognition
  • The President has the power to recognize the
    legitimacy of another state by receiving a
    diplomat from that state.
  • It is a key way to assure a new state survives.
  • The rebuke of a countrys status is called
    persona non grata.

  • This power is almost limitless.
  • The President could actually lead troops into
    battle.
  • The President can send troops into harms way
    without Congressional approval.
  • Wartime powers are even greater than during times
    of peace.

  • The War Powers Resolution of 1973 placed certain
    limits on war powers.
  • 1. Within 48 hours the President must convey to
    Congress the reason for the use of force.
  • 2. Commitment must end in 60 days unless
    Congress approves a longer period. 30 extra days
    are allowed to withdraw troops.
