Purpose of IO

• Protect US persons constitutional rights
  privacy
• Collect by least intrusive means
• Disseminate information only for lawful
  government purposes

What is a US Person?

• A United States citizen
• An alien known by the LEA to be a permanent
  resident alien
• An unincorporated association substantially
  composed of US citizens or permanent resident
  aliens
• A corporation incorporated in the US

IO Procedures Applicable to CD Operations

Procedure 1

• Must not infringe upon constitutional rights
• Based on lawfully assigned function
• Use least intrusive means
• NG has no independent authority to collect,
  process, retain, or distribute

Reconnaissance and Surveillance

• Intel Oversight does not prevent us from imaging
  point targets
• Legal concerns, not Intel Oversight, has led the
  National Guard Bureau, to not allow Title 32
  personnel to do reconnaissance or surveillance
  when it is directed at specific individuals or
  make arrests.

Procedure 2 General Provisions

• Based on proper function of organization
• Must be counterdrug activities
• Must be performed under LEA jurisdiction

Procedure 3 Storage of Information
Surveillance

• Information cannot be retained at NG facility
• NG does not participate in surveillance directed
  at a specific individual(s)
• Information must remain at LEA facility
• Translations may be performed at NG facility

Procedure 4 - Dissemination

• NEED TO KNOW
• Illegal activities may be reported to an LEA
• Federal government agencies (non-LEA
  non-intelligence) may receive info only as
  related to the performance of lawful government
  functions of the agency

Procedure 7 Physical Searches

• No physical searches unless
• Assisting in executing search warrants under
  supervision of LEA officer
• Trained by LEA prior to search

Procedure 14 Your Responsibilities

• Adhere to EO 12333
• Be familiar with procedures 1-4
• Be familiar with other procedures that apply to
  your organizations activities
• Report questionable activity

Procedure 15 Reporting

• Improper and/or questionable activities
• If in doubt, call IO Monitor
• Early reporting can minimize damage
