State or Country?
This is a query that I've heard quite a bit. I
was approached by many Italian investors during a
recent trip to Italy who wanted to know if they
might invest in the US by buying real estate,
which could be anything from single-family houses
to hotels. Many opportunities for cross-border
investing now exist, both within the United
States (intra-country) and internationally thanks
to technology and the global exchange mentality.

How to start investing in US Real Estate From
Another State or Country?
Ideal for both US and foreign real estate
investors Every real estate investor should
have a registered business company or agent in
the state they intend to conduct business.
Foreign investors are required to obtain a US
taxpayer identification number (TIN) prior to
making a real estate purchase under the terms of
FIRPTA (Foreign Investment in Real Property Tax
Act).

Recognize the tax repercussions of investing in
other States, particularly in relation to the
home State or Country. Selling US real estate
generates sales income that is subject to capital
gains tax. The Sale Price today less the Original
Sale Price, plus Capital Costs, less
Depreciation, is used to determine the Capital
Gains tax. Investors who want to postpone tax
liability should think about a 1031 Exchange.

Revenue Tax Unless they choose the "net election"
on their income tax forms, which allows them to
deduct normal expenditures before income tax is
calculated, foreign investors are taxed at a flat
federal rate of 30 on gross rental revenue.

those from abroad, should speak with attorneys
and title companies with experience in overseas
investments and escrows that can handle foreign
currency.
