  • What Are the Grounds for Divorce?
  • Divorce is basically the legal procedure of
    termination of a matrimonial relationship or
    marriage. Divorce generally involves the
    reorganizing or cancelling of a married couple's
    legal obligations and liabilities under the law
    of that state or country, thereby dissolving the
    legal bonds of marriage under the stipulated law.
    In some states, divorce is also referred to as
    dissolution of marriage. In the United States,
    divorce law is governed by a system of limited
    divorce remedies, under which a divorce decree
    may be granted to one party only, while the other
    party is granted only the divorce mandamus, stay

  • Under the common law, there were no divorce
    remedies at all, but there have been many changes
    in that area of law over the years, including the
    common divorce remedy of affidavits. An affidavit
    generally declared that the spouses are not in a
    state of matrimonial bliss and that the union is
    irretrievably broken. The spouse filing the
    affidavit must produce the marriage certificate
    of the other spouse, unless it can be proved that
    the marriage was legally dissolved in some other
    way, such as through a court order under some
    other statutes that govern marriage. In this
    case, that party filing the affidavit is not
    required to produce any marriage certificate.

  • Another form of divorce remedy called for a
    showing of an imbalance of their communal
    property. A typical example was where one spouse
    had a large estate, while the other had very
    little, or no estate at all. Under some
    jurisdictions, this is still a common divorce
    argument today. Under the common law, the court
    ordered a partition of the communal property in
    favor of each party, based on what was known as

  • In other states, however, there are no divorce
    proceedings required if the divorcing parties are
    living in a common-law marriage. Instead, the
    spouse must file a legal separation agreement or
    an uncontested divorce decree. Again, if proof is
    required to support the court's equitable
    distribution decision, that party is exempt from
    having to provide a certificate of corroborating
    evidence. Again, the divorce decree is generally
    quite dissimilar from the marital settlement
    agreement, because it doesn't involve any
    conjugal property issues. The divorce forms may
    include various instructions as to what the
    division of property and child custody will be.

  • In more recent years, the concept of a
    "justifiable divorce" has become more common. A
    divorce is considered "justifiable" when one of
    the spouses is unable to obtain the services of
    an attorney to protect his or her interests after
    separation. Usually, this involves a party not
    having access to a computer or the means to make
    an online home-based business. A spouse with
    financial or personal resources may be able to
    have an attorney to file for a divorce, but not
    always.

  • One of the advantages to hiring an attorney to
    file for divorce is that the attorney will make
    sure that all of the proper filings are made, and
    that all of the creditors and their proofs of
    claim are submitted to the court. It is also
    often the case that an attorney can obtain other
    financial records, such as tax returns, to
    substantiate a claim for marital assets. In some
    cases, the filing party may choose to hire a
    mediator to assist in the divorce proceedings.
    Whatever the case, hiring an attorney is the best
    way to ensure that the divorce is processed in
    the manner prescribed by law.
