Possible Defenses In An Aggravated Assault Case
2
Introduction
In cases where you are charged with the crime of
an aggravated assault, your lawyer will check on
three types of defences. Your lawyer will try his
best to defend you in the case provided there is
any one of these points present in your case.
This presentation will share with you three
possible defences for you in an aggravated
assault case.
3
Innocence
If you are really innocent and were not there at
the time of incident, it is the strongest alibi
for you to prove your innocence. The lawyer will
not have to do much in such a case. He will have
to present a couple of witnesses who can testify
that you were with them at the time of the
assault and not at the spot where the incident
occured.
4
Self-defence
Another point that might be a way for your
defence is self-defence. There are chances that
you might have committed the assault with an
intention of defending yourself. If you did
something illegal while defending yourself, the
charges against you can be eased and minimised.
Lawyer must be told about exactly what happened
so that he can make it a self-defence scenario if
it is the case.
5
Lack of evidence
Third type of defence that can favour you is in
the case the other partys evidence is weak and
can be challenged in the court. If there is not
much evidence against you, your lawyer can help
you get out of it. For instance, there is a
possibility that there is only an audio proof of
your assault. Audio evidence is not reliable and
is not considered valuable or acceptable in the
court.
6
Conclusion
You just have to talk in detail to your lawyer so
that he knows all the bits and pieces of the
incident so that he can do what is the best
possible outcome for you. There are more than one
way to defend you from the punishment. You just
have to believe in your lawyer and not hide
anything from him.
