Description:

Generally, the output of a valuation exercise is a range of values for a given situation. Also, it must be noted that for different situations, the same patent(s) may have varying value ranges. Hence for an acquisition proposition, the patent(s) would have a certain value, whereas for licensing purposes, the same patent(s) would have a different value. Service industry for patent prior art search, A
patent application typically goes through a
rigorous examination process before being granted
by the respective patent office(s). For this
situation, it is important to understand the
territorial nature of intellectual property
rights, as well as what makes an IPR enforceable.

PATENT VALUATION
In the current knowledge economy era, a large
percentage of an organizations value is vested
within its intellectual property rights. This is
true regardless of whether the organization is
large or small or a startup. In fact, it has
been noted that 100 of the value of some
startups are attributed to their intellectual
property rights. In such a scenario, the
valuation of the patents owned by an organization
becomes an important task. Valuation is detail
oriented task and is highly dependent on the
desired outcome of the exercise. It involves
several steps including ensuring that all the
paper work towards ownership has been registered
with the respective authorities, assessment of
the alternate solutions, evaluation of the
strength of the patent(s) in question in light of
the alternates, etc. before attributing a
monetary value to the patent(s).Next Page

PATENT VALUATION
In the race to acquire as much patent territory
as possible by organizations, very often there
may be some oversights and misses that could
prove costly in the long run. This may take
various forms, shapes and sizes. For example,
during the course of filing, one or more
jurisdictions of interest may be missed out.
Alternately, in the rush to gain competitive
advantage by filing quickly, some important
aspects of the technology may have been omitted.
Many other such situations may be envisioned if
one hasnt experienced the suggested nightmare
scenarios. The immediate consequence of such an
oversight would be the inability to enforce any
rights resulting in the possible opening up of
the market to competition. Such oversights and
omissions will be highlighted during a patent
portfolio analysis following which, suitable
steps may be taken towards risk mitigation.
