• Businesses must declare in writing that proves
  they have the strong and genuine commitment to
  employing overseas skilled workers and will not
  engage in discriminatory recruitment practices.
• Businesses must also meet the training benchmarks
  if traded in Australia for more than 12 months
  and in case of less than 12 months, one must have
  an auditable plan to meet the training
  benchmarks.

• When it comes to sponsor skilled worker under 457
  visa, the businesses outside Australia must
  intend to establish a new business in Australia.
• Businesses should also fulfil contractual
  obligations that employer has in Australia.
• If the businesses don't have an operating base in
  Australia, they don't need to meet the training
  requirements.
