  • The functions of the District Government will be
    subject to following limitations
  • District Government shall exercise such authority
    within the district in accordance with general
    policy of the Government.
  • District Government shall be responsible to
    Government for improvement of governance and
    delivery of services within the ambit of the
    authority decentralised to it under this
    Ordinance.
  • Zila Nazim shall be head of the District
    Government.
  • District Coordination Officer shall be the
    Coordinating head of the District Administration.
  • Executive District Officer shall be head of the
    group of District offices.

Recall of Zila Nazim
External
Through a resolution of provincial Assembly
approved by a simple majority of the total
membership of Provincial Assembly.
Internal
If a recall motion is approved by Majority vote
of total membership of ZC through secret ballot,
the Election authority shall cause a vote to be
cast by the members of Union Councils in the
district and if the motion is approved by simple
majority of the total members of union council in
the district the Zila Nazim shall cease to hold
office.

Zila Council
Zila Council shall have a Secretariat under the
Naib Zila Nazim who shall be its convenor. The
Zila Council shall meet at least once every month
and shall be in session for at least fifty
accumulated days in a year. The important
functions of Zila Councils will be as follows
  • Approval of bye laws.
  • Approval of local taxes relating to District
    Government.
  • Approval of Development Plans.
  • Approval of the Annual Budget.
  • Election of Monitoring Committees.
  • Election of Zila Accounts Committee
  • Election of members of Zila Council for District
    Public Safety Commission.
  • Review the Audit Reports of Zila accounts
    Committee.

Some of the additional functions of Zila Council
in City District will include the development and
management of the following services
  • Water source development and management, storage,
    treatment plants, and macro-distribution.
  • Sewage tertiary and secondary network, treatment
    plants, and disposal.
  • Solid waste management, treatment and disposal,
    including land fill sites and recycling plants.
  • Urban design and urban renewal programme
    promulgation of building rules and planning
    standards.
  • Parks, forests, play grounds, sporting, and other
    recreational facilities.

Structure of Tehsil/Town Municipal Administration
Tehsil Nazim to be head of the Tehsil Municipal
Administration to be assisted by other Tehsil
Officers. Tehsil Municipal Administration shall
include the office and sub offices of

AT TMA GUJRANWALA SADAR Management of
Responsibilities in the absence of Rules
A. Arranged on-job training sessions on daily
basis with the help of available skilled officers
/ officials B. By using the saving clause,
fulfilled the requirement from relevant Rules
framed under PLGO 1979 which are not
contradictory with the new system. C. Conducted
surveys / cross surveys before formulation /
implementation of Taxation Schedule / Bye Laws.
Although most of them were resented subsequently
at different stages.

Ban on hiring of staff
  • Increase the working hours with mutual consent
    without incurring extra expenditure. All
    officers were working more than sixteen house per
    day in the first half year. But we could not pay
    any incentive bonus due to the none availability
    of policy rules on the subject.
  • Re-adjust the available staff including devolved
    departments and defunct CO Units according to the
    need and requirement. However we did achieve
    better efficiency and the lesser staff caused
    lesser non-development expenditure.

  • Tehsil Nazim arranged meetings of Union Nazim /
    Naib Union Nazims for identification,
    prioritisation, monitoring and execution of the
    projects.
  • With a Vision to prepare a comprehensive 3-4 year

    process of discussion.

Long Term Planning exercise
  • In consultation with Union Administrations and
    notables of the area, the development schemes
    have been identified and after prioritisation
    included in the ADP of TMA.
  • For long term Spatial planning, SUPARCO had been
    contacted for the preparation of GIS base map.
    However later on the same is being managed
    through PMDFC with the assistance of WORLD BANK
    so that master development / spatial plan of the
    area could be developed. Thus enabling TMA to
    plan urban development according to the present
    and future visualized needs.

    given resources to spend as per their own

WEAKNESSES
  • Weaknesses of the system stem from unclear
    responsibilities and roles, gaps in
    interrelationships among various actors, one
    formula for all approach, absence of devolution
    from federal to provincial levels, failure to
    undertake financial repercussions, issues
    relating to the capacity of both elected and
    other officials and bottlenecks in
    implementation. The set-up however offers many
    opportunities in the shape of hopes for
    empowerment of people and resolution of their
    local problems at local levels. The system is
    receiving unprecedented support from
    international partners as well. But at the same
    time, the system is at risk due to political
    reasons and troublesome constitutional position. 
  • Given the status of development in Pakistan,
    issues in participation, development management
    and social services, reversal of the policy of
    local government development through devolution
    is not an option. Rather steps need to be
    initiated which will enable removal of
    bottlenecks faced by the setup in order to bring
    the fruits associated with devolution to the
    people of Pakistan.

Conclusions Recommendations 
  • GENERAL
  • 1.      Institutional reform is a time consuming
    and demanding process. All stakeholders in the
    process should recognize this fact. While
    continuity is the key to success, it must be
    insured that suitable mechanisms are installed
    which will facilitate constant monitoring and
    troubleshooting of the process.
  • 2.      Political will to undertake this reform
    process should continue.
  • MEANINGFULL COMPLETION OF DEVEOLUTION TRANSITION
    DECENTRALIZATION
  •  
  • The proper handing taking accountability of
    assets (fixed and moveable assets could be any
    kind of machinery, equipment stores) is still
    missing due to poor implementation of devolution
    transition program. Therefore the transfer by
    handing taking over of assets as well as one time
    disposal of nonworking or unserviceable assets
    must be conducted as well rational for
    procurement of new assets must be worked out so
    that institutional functioning becomes effective
    in delivery of service and contributory towards
    national development in the best public interest

  • TRANSFER OF FINES TO THE TMAs LOCAL FUND
    ACCOUNTS.
  • It is being observed that whenever some of the
    cases were referred to the court of Area Mage
    straits then after his decision of fining to the
    defaulters the same amount of fines have not been
    transferred to the TMA accounts. Similarly the
    traffic police is also laving fines and since the
    traffic management remains the subject TMAs thus
    the same should have been deposited in the TMA
    accounts..

  • ARRANGEMENTS OF FINANCE COMMISSIONS OR FINANCE
    COMMITTEES AT ALL LEVELS OF LOCAL GOVERMENTS.

  • Similar to the Provincial Federal Governments
    at all the levels Local Governments Union
    Administrations at TMA DISTRICT levels, TMAs at
    Districts Provincial there is a requirement of
    Finance Commissions or Committees to help in
    devising formulaes specifically for deciding the
    fiscal transfers and grants etc. But for TMA
    Districts proper rationales must be worked out to
    ensure homogeneous socio sector development as
    well as the other economic development
    activities. This would help in achieving
    rationalized equal development activities in all
    the urban rural areas without discrimination.

  • All kind of socio economic data collection
    arrangements (as per PLGO) must be
  • Strictly enforced at Union Administration levels
    as well as the transfer of the same at TMAs
    District levels must adhered too. This way it
    would continuous, easy cheap and automatically
    updating at all levels and times. Thus very
    useful particularly while carrying out planning
    at TMAs, District, Provincial and National
    levels.

Gentlemen ,to ensure speedy development with a
just management of affairs the political vision
needs good administration to implement the
vision, and good administration needs a clear
political vision.To summarized it is
imperative to fully adopt the given PLGO in
letter and spirit. The system be strengthened by
making true financial resource assessment and
long term development need assessment of all TMAs
with the visualized national objectives. However,
all kind of political interferences by MPs,
re-creation of devolved departments and vertical
developments be stopped. While, fiscal transfers
be smoothened and other system strengthening
tools like rules and bye-laws must be refined, to
ensure achievement of useable, accountable,
sustainable / maintainable structural and human
resource development in the best public interest
