General Attendance Requirements Clarification
  • Residency
  • A student can not enroll on the basis of another
    persons residency, including a parent or
    grandparent

    direct instruction must meet the NCLB highly
    qualified teacher requirements.

  • Active duty refers to military members who are

    designed to make the rules easier to understand.
  • Documentation Requirements have been expanded and
    clarified.
  • If a student returns to campus for any reason
    before the first day of the 4th week, a Medical
    Release from a medical or nurse practitioner must
    be obtained to permit the return.

Pregnancy Related Services
  • Doctor notes and releases can be obtained from a
    Medical or Nurse Practitioner licensed to
    practice in the US.
  • Doctor notes must document that a medical
    necessity for confinement is required in
    accordance with the International Classification
    of Diseases (ICD9 Code).

Pregnancy Related Services
  • PRS and Special Education Services. (SPED) The
    prenatal or postpartum SPED student confined to
    the home or hospital bedside must be served
    collaboratively by SPED and PRS with homebound
    and CEHI according to the charts even when the
    student is anticipated to be confined for less
    than 4 consecutive weeks or less than 4 weeks
    total.

Non-Traditional Schools Clarifications
  • A student must be enrolled for at least 2 hours
    (120 minutes) of daily instruction to be counted
    as on-half day membership and at least 4 hours
    (240 minutes) of daily instruction for full day
    membership
  • A student may not be double counted for ADA while
    attending both a regular school program and a
    non-traditional education program

Non-Traditional Schools
  • A student younger than 10 years of age shall be
    removed from class and placed in a DAEP (TEC
    37.008) if the student engages in conduct
    described by TEC 37.007. An elementary student
    may not be placed in a DAEP with any other
    student who is not an elementary student.

Non-Traditional Schools
  • A student enrolled in a JJAEP is reported as if
    the student were enrolled at the students
    assigned campus in the students regularly
    assigned education program, including a special
    education program. Services must be provided to
    enable the student to progress in the general
    curriculum in these 2 instances
  • A child with disabilities has been removed for
    more than 10 school days and is subjected to a
    subsequent removal for not more than 10 days at a
    time
  • When a child with a disability has been suspended
    or expelled for behavior not a manifestation of
    the childs disability

  • Optional Flexible School Day
  • Feedback is being gathered as part of the process
    to define how this program will be administered.
    An addendum will be published after rules are
    adopted.
