Changes in IRS regulations governing 403(b)
plans effective January 1, 2009

Why did the IRS issue the new 403b regulations?
  • IRS audits have identified significant compliance
    gaps when there is insufficient employer
    oversight
  • Eligibility and opportunity to enroll
  • Distributions prior to termination
  • Hardship withdrawals that exceed actual hardship
    amounts
  • Loans that exceed 50,000 in the aggregate
  • Dishonest self-certification on transfer, loans,
    hardships, distributions
  • Insufficient disclosure of fund expenses/fees

What is the overall impact?
  • Most substantial regulatory changes to 403b plans
    in 40 years
  • 403b plans will operate more like 401k plans,
    which require good compliance records
  • The administrative challenge Make 403b plans in
    a multi-vendor environment operate like 401k
    plans, which are typically exclusive
  • Compliance is a top IRS priority
  • Plan compliance is the employers responsibility

What HR has done to comply?
  • Reviewed number of participants across 24 ORP,
    403b, 457b vendors
  • Identified top 6 vendors w/ than 200
    participants, i.e., TIAA-CREF, AIG Retirement
    (VALIC), Fidelity Investments, Lincoln Financial
    Group, American Funds
  • Froze new contracts w/ all but three 403b vendors
    effective 9/27/07 to comply w/IRS regs
    (TIAA-CREF, AIG Retirement, Fidelity Investments)
  • Effective 11/1/2008, reduced number of approved
    403b 457b vendors to four TIAA-CREF, AIG
    Retirement (VALIC), Fidelity Investments,
    Lincoln Financial Group

  • We negotiated new 403b 457b mutual fund
    platforms w/approved vendors
  • AIG Retirements 403b 457b platform was
    effective 8/1/2008
  • Lincoln Financial Groups 403b 457b platform is
    effective 11/1/2008
  • TIAA-CREF Fidelitys 403b 457b platform will
    be effective 1/1/2009 (through 12/31/2008
    existing vendor funds)
  • Adding post-tax Roth 403b plans
  • We designed easier to use 403b 457b platforms
    that have two to four tiers
  • Tier 1 (Target/age-based retirement funds)
  • Tier 2 (Best-in-Class funds across asset
    categories)
  • Tier 3 (Vendor proprietary funds)
  • Tier 4 (Self-directed brokerage service/retail
    portal)
  • We are preparing communication to send to all
    403b participants 403b vendors
  • Participants with non-approved vendors may leave
    current contributions in existing accounts must
    direct new contributions to four approved vendors
    as of 1/1/2009
  • Participants with approved vendors may need to
    convert to new fund platform

What does it mean to you?
  • You will have same fund choices through fewer
    vendors
  • The new tiered 403b 457b mutual fund platforms
    are designed to make retirement and investment
    planning easier we will post quarterly fund
    performance for Tiers 1 and 2
  • With fewer vendors, you will better understand
    your choices, expenses, etc.
  • You will see more educational information on the
    HR Web site re financial planning, investment
    planning, wealth management services, education,
    etc.
  • We will provide ongoing education e.g., seminars,
    Webinars, mailings, etc.
  • Through FMEC, HR will be proactively reach out to
    faculty and staff for one-on-one appointments w/
    vendor reps and HR reps
  • We will be implementing Retirement Manager, a
    single retirement planning tool/system called for
    participants featuring on-line self-enrollment
    for 403b 457b vendors fund transfers/changes
    educational information compliance monitoring
    and processing (hardships, loans, limits,
    catch-ups, etc.)

  • You must be enrolled in the HSA PPO plan to be
    eligible for an HSA
  • The BOR has contracted with USbank to provide an
    HSA for all system institutions
  • All HSA PPO plan enrollees will receive
    enrollment information from USbank
  • If you enroll in the USbank HSA, you may
    contribute through payroll deduction on a pre-tax
    basis
  • If you arrange another HSA, no payroll deduction
    is available

  • MetLife is the plan administrator for 2009. No
    changes to the dental plan coverage or rates.

The Board of Regents makes an annual decision
whether to allow open enrollment in the dental
plan. Please give special consideration to
enrolling, with the knowledge that you may not be
able to enroll next year during the open
enrollment period.

Long-Term Disability Insurance(LTD)
  • Special enrollment this year lower premiums
    increased coverage in 2009

  • Effective January 1, 2009, the LTD insurance
    benefit increases from 60 to 66 2/3 of your
    income if you are unable to work for at least 90
    days as a result of serious illness or injury
  • The cost of the plan is determined by your salary
    and age

  • You may change your ORP companies during any
    payroll period (usually no more than 12 time
    p/yr) no need to wait for open enrollment
