    other than by way of a sale

LICENSING POLICY
  • Each Licensing Authority must, in respect of each
  • three year period
  • Determine its licensing policy and keep it under
    review and revised as appropriate
  • Publish a Statement of Policy
  • Formally review the Statement every three years
  • Determine and review enforcement policy

LICENSING COMMITTEES
  • Each Licensing Authority must
  • Establish a Licensing Committee consisting of at
    least 10 but not more than 15, members of the
    Authority
  • From these members the Licensing Committee may
    establish sub-committees sitting as a quorum of
    three
  • More than one sub-committee may sit at any one
    time

  • Responsibilities of Licensing Committees
  • The Licensing Committee discharges functions on
    behalf of the Licensing Authority, except where
    it relates to the determination of the Licensing
    Policy or is a non-licensable function
  • The Licensing Authority is encouraged to
    delegate certain functions to officers

PREMISES LICENCE
  • PREMISES LICENCE means a licence granted under
  • the Act in respect of any premises which
    authorises the
  • premises to be used for one or more licensable
  • activities
  • Premises can mean a building or open space

  • Relevant licensable activities

  • Any other times the premises are open to the

PERSONAL LICENCES
  • What is a Personal Licence?
  • A licence granted to individuals for the sale of
    alcohol. This is a portable licence permitting
    the licence holder to move freely between
    premises that hold a premises licence
  • It is only required for the sale of alcohol and
    not for other regulated activities

  • Criteria for Personal Licences
  • All applicants must be 18 or over
  • Possess an accredited licensing qualification
  • No personal licence forfeited in previous 5
    years
  • Have no relevant convictions
  • Pay requisite fee
  • Granted for 10 years

  • Relevant Convictions
  • Those involving serious crime
  • Those involving serious dishonesty
  • Those involving drugs
  • Those requiring an entry on the sex offenders
    register
  • Breaches of licensing law

CLUB PREMISES CERTIFICATE
  • Available for qualifying clubs (registered
    clubs)
  • Supply of alcohol to Club Members and bone-fide
    guests
  • No designated premises supervisor required
  • No personal licence holder required
  • Not subject to closure orders

TEMPORARY EVENTS NOTICE (TEN)
  • Regulation of licensable activities in premises
    (can be open space) not subject to a Premises
    Licence or Club Premises Certificate
  • Permission is not required from Licensing
    Authority

  • Maximum number of people - 499

LATE NIGHT REFRESHMENT
  • A person provides late night refreshment if
  • Between 23.00hrs and 05.00hrs
  • Supplies hot food or hot drink
  • To members of the public
  • On or from any premises
  • For consumption on or off the premises
