ARTICLE 139, UCMJ
Article 139 of the UCMJ, titled Redress of
Injuries to Property, provides an administrative
mechanism for assessing the pay of a soldier to
pay restitution to the victims of certain types
of criminal offenses committed by the soldier.
Article 139 only applies when a person subject to
the UCMJ ( i.e. a soldier, willfully damages or
wrongfully takes the property of any person).
Article 139 does not cover cases of negligence,
personal injuries, wrongful death, and theft of
services, subrogated (third party claims),
contractual and fiduciary disputes, or claims for
consequential damages.
