  • And an act of Congress which deprives a citizen
    of the United States of his liberty or property,
    merely because he came himself or brought his
    property into a particular territory of the
    United States, and who had committed no offense
    against the laws, could hardly be dignified with
    the name of due process of law.

Topic or Main Idea
  • The idea of the verdict in the case Dred Scott
    vs. Sanford was that a slave was considered
    property and therefore was unable to sue in a
    court legally because a slave was not considered
    equal to a white man.

Point of View or Bias
  • The judge who declared the verdict had general
    sympathy toward slave freedom suits was favorable
    to Dred and Harriet Scott but when it was moved
    to another court, the Scott's lost the favor
  • Reached the conclusion that no person descended
    from an American slave had ever been a citizen
    for Article III purposes. The Court then held the
    Missouri Compromise unconstitutional, hoping to
    end the slavery question once and for all.
