Review Criteria
  • Under the provisions of Section 10.26, F,1 of the
    Commission's Land Use Districts and Standards,
    the maximum building height for residential
    structures is 75 feet. Section 10.26, F,3 allows
    maximum building heights to be exceeded for
    structures with no floor area (such as towers)
    with Commission approval.
  • Under the provisions of Section 685-B(4) of the
    Commissions statutes, 12 M.R.S.A., the
    Commission shall approve no application, unless
    adequate provision has been made for fitting the
    proposal harmoniously into the existing natural
    environment in order to assure there will be no
    undue adverse effect on existing uses, scenic
    character, and natural and historic resources in
    the area likely to be affected by the proposal.

Staff Recommendation
  • The applicants proposal meets the relevant review
    criteria for approval as specified under the
    provisions of Section 685-B(4) of the
    Commissions statutes, 12 M.R.S.A. and
    appropriate sections of Chapter 10.
  • Therefore, staff recommends approval of Building
    Permit BP 9589-C.
