APD Background Information
  • Background
  • In October 2004, the Agency for Persons with
    Disabilities (APD) became an agency separate from
    the Department of Children and Families,
    specifically tasked with serving the needs of
    Floridians with developmental disabilities. Prior
    to that time, it existed as the Developmental
    Disabilities Program.
  • Mission
  • The Agency Supports Persons with Developmental
    Disabilities in Living, Learning and Working in
    their Community.
  • Clients
  • APD serves clients with the following
    developmental disabilities Spina Bifida, Autism,
    Cerebral Palsy (CP), Mental Retardation, and
    Prader-Willi Syndrome.

Deed Restriction
  • In 1969 the State of Florida was deeded
    approximately 50 acres of land on Hodges
    Boulevard with the deed restriction that the land
    be used by the State of Florida for the benefit
    of mentally retarded, or for similar public
    purpose.

Purpose of Meeting
  • Gather ideas and feedback from the community and
    interested parties for the best use of the 38
    acres of Hodges land in accordance with the deed
    restrictions

Background Information on Hodges Property
  • In 1969 the State of Florida was deeded
    approximately 50 acres of land on Hodges
    Boulevard with the deed restriction that the land
    be used by the State of Florida for the benefit
    of mentally retarded, or for similar public
    purpose.
  • The state developed a portion of the land to
    provide space for The Agency for Persons with
    Disabilities (APD) Area 4 Administration
    buildings and an Intermediate Care Facility for
    Persons with Disabilities (ICF/DD).
  • The ICF/DD portion of the land is sub-leased to
    National Mentor Healthcare, L.L.C. (Mentor), a
    for-profit business which provides residential
    housing and care for persons with disabilities.
  • The sub-lease between APD and Mentor expires in 7
    years.
  • The land lease between the Board of Trustees of
    the Internal Improvement Trust Fund of the State
    of Florida and APD expires in 59 years.

Who Can Give a Proposal?
  • Any entity with a proposal that
  • fits the criteria of the deed restrictions and
  • supports the agencys mission.
  • The land may be subdivided and developed by any
    number of entities to achieve the best possible
    use.
  • Please note that the State has the right, at any
    time during the process, to reject any and all
    proposals that are not, in the States sole
    discretion, in the best interests of the State.

Role of APD
  • As the lessee of the Hodges property, APD has the
    authority to sublease any part of the land so
    long as the sublease shall effectively carry out
    the general purpose of the lease.
  • APD roles
  • Gather and evaluate proposals for the best use of
    the Hodges property.
  • Submit a recommendation to the Department of
    Environmental Protection.
  • Enter into sublease with one or multiple entities
    for the purpose of developing and maintaining the
    property in accordance with the deed restriction.

Sublease Process
  • APD receives proposals and evaluates them based
    on the deed restriction and the best interest of
    the State.
  • APD submits recommendations to the Department of
    Environmental Protection (DEP) for legal review
    and compliance with the deed restriction.
  • Land surveys and legal descriptions are obtained.
  • DEP drafts sub-lease documents and submits to the
    new sub-lessor(s) for execution.
  • Sub-lease documents are sent to APD for
    execution.
  • The Board of Trustees of the Internal Improvement
    Trust Fund of the State of Florida are the last
    to review and execute the sub-lease documents.
