    Units, annual Global e-Readiness survey.

Act
  • Review of the Electronic Transactions Act (ETA)
  • Bermuda was one of the first jurisdictions in the
world to enact E-Commerce legislation, which was
then served as a model for other countries.
  • The present review is being undertaken to ensure
that it till meets stakeholder needs and best
practices, given the ETA is now 10 years old and
    the international technology landscape has
    changed.
  • Bermuda is one of a few small jurisdictions that
has legislation protecting children from internet
luring and other instances of online
    victimization.

13

  • A Working Party is currently reviewing draft
    privacy legislation
  • The model is unique but is based on
    well-established principles

Telecommunications Regulatory Reform - Drivers
  • Technological Convergence
  • Current license structure impedes technological
    convergence.
  • REMEDY
  • Technology and service neutral Communications
    Licenses (CL)
  • Transition to CL requires changes with respect to
FDI rules, dominance regulation, and regulatory
    and license fees.
  • Regulatory Structure
  • Current process lacks transparency,
    predictability, and accountability.
  • Worldwide trend to have regulatory authority in
    an autonomous Commission
  • REMEDY
  • Create independent Regulatory Authority.
  • Separate regulatory function from policy making
    role.
  • Judiciary to rule on appeals.

15
Telecommunications Regulatory Reform Target
Outcomes
