Teachers Responsibilities
  • The duty to instruct
  • The duty to supervise
  • Parents do sue if a child gets hurt in school on
    the playground, in gym, or in class.
  • The duty to properly maintain equipment

Teacher Liability
  • A teacher is not required to anticipate the
    myriad of unexpected acts which occur daily in
    and about school, to guard against all dangers
    inherent in the rashness of children or to watch
    all movements of children.
  • BUT.

Duties
  • It is the duty of the teacher, as a reasonable
    and prudent person, to guard against such
    accidents as are reasonably foreseeable.

Three basic duties
  • The duty to supervise
  • The duty to exercise good judgment
  • The duty to instruct as to correct procedures,
    particularly (but not exclusively) when
    potentially hazardous instrumentalities are
    present.

What about the classroom?
  • NO ALCHOL LAMPS OR GLASS CONTAINERS (And be very
    suspicious of candles or other fire!)
  • Is there a safety issue in the classroom? Put
    the concern in writing and ALTER instruction to
    make it safe!

Sometimes it is difficult for children to
separate danger from fascination.
  • Provide additional safety parameters goggles,
    fire prevention, additional supervisors (parents
    and volunteers)
  • Limit the activity to a teacher demonstration, in
    which the teacher manipulates the equipment and
    the students become observers.
  • Eliminate the activity entirely from the
    curriculum.
  • Ask if other teachers would endorse the
    activities.

Accidents in the classroom
  • Would the accident have happened if those who had
    the management and control used proper care?
  • Dont try this at home! You are liable for the
    assignment if a student does.

Troubling Situations
  • Dont leave your class unattended.
  • Use safety rules and contracts.
  • Never have a substitute do experiments!
  • Never allow students to work alone!

Animals in the Classroom
  • Get parental permission.
  • Provide proper care.
  • Teach students proper handling techniques.

Plants in the Classroom
  • Poisonous Plants
  • Wash skin after exposure to sap or juice.
  • Dont pick unfamiliar plants.

Chemicals in the Classroom
  • Do not mix to see what will happen!
  • Never allow tasting and touching.
  • Limit amount stored in the classroom.
  • Use safety precautions.
