What is The Procedure for Registering a Copyright
?
Copyright
2
What is Copyright ?
  1. Copyright is a legal right that grants you some
legal protection in the original work and permits
you to use your original work in the form of
reproduction or selling to the public while it is
in physical form because that can be covered by
the copyright registration. Even though copyright
registration is not at all required in India,
doing so is still a good idea. Anything under
literature, music, art, photography, cinema or
film, or even a computer programme, etc., may be
considered part of the aforementioned work. The
symbol can be positioned on the originally
created piece of work, such as .

Who Has the Right to Register a Copyright ?
The person who has obtained rights to the
original work as well as the work's creator may
register for the copyright. Anyone who asserts to
have acquired ownership rights from the original
work's creator or a representative who has been
given permission to act on their behalf can
register for a copyright. If two people
collaborated to create a piece of work, the
copyright belongs to both of them unless the
parties involved specify otherwise. Since there
is no age restriction for obtaining copyright,
minors can also register one.

Copyright registrations have some advantages
  • The material's owner is able to file a lawsuit
    against the infringers.
  • You can actually see that this type of
registration has advantages on both the legal and
    monetary levels.
  • It discourages those who steal your work from
doing so. Torrents and other issues could have
made this a little more challenging.
  • If you own the copyright, you can also use it as
a powerful marketing tool to demonstrate your
    qualifications.

Copyright Registration Process
  • Step1 File the Form It is necessary to
file the Form XIV as specified in the first
schedule to the Rules. After submitting an
application for copyright registration with all
    necessary information and supporting documents,
the author must wait 30 days.
  • Step2 Acknowledged by the Attorney The
applicant or the attorney in whose favors a
Vakalatnama or Power of Attorney has been
executed must sign the applications. The Power of
Attorney that the attorney has accepted. Also
included should be the Power of Attorney, which
must be signed by the party and acknowledged by
    the attorney.

  • Step3 Fees Demand draughts, Indian Postal
Orders made payable to the "Registrar of
Copyright Payable at New Delhi," or electronic
payments may be used to pay the fee.
  • Step4 Finally Registered In the normal course,
copyright registration requires two to three
months of time for any work.

8
Step5 Counter Argument As I previously stated,
the owner of the copyright must wait the required
30 days. This waiting period is for any
objections that might be made against the
applicant's work in the copyright office. If an
objection is made, it might take another attempt
to decide whether or not the work can be
registered. To determine whether copyright
registration is lawful, both parties are given
the chance to be heard. However, if no objection
is raised within the allotted time, the examiner
will formally review the application. If he finds
any errors, he may then raise objections or
request additional documentation. Step6
Certificate of Copyright Registration The
applicant receives a Certificate of Copyright
Registration after finishing all of these steps.
