DUI PENALTIES IN CANADA

INTRODUCTION
In Canada, drunk drivers are charged with having
a blood alcohol level over 80 mg per 100 ml of
blood. Since driving under the influence is a
crime, the conviction can lead to penalties that
can have a serious impact on your life.
4
DUI Penalties
The Criminal Code prohibits driving while
impaired to any degree either by drugs, alcohol
or the combination of both. Here are some of the
consequences of being found guilty of DUI
offence
5
DUI Penalties In Canada
  • It depends whether the accused has committed the
crime for the first, second or third time. The
    minimum sentences are
  • For a first offence, a 1000 fine and a 12-month
    driving prohibition,
  • For a second offence, 30 days of jail and a
    24-month driving prohibition
  • For a third or subsequent offence, 120 days of
jail and a 36-month driving prohibition

DUI Penalties In Canada
  • Other DUI penalties may include
  • A mandatory ignition interlock device on the
    driver's vehicle
  • Mandatory completion of a drug rehabilitation
    program
  • Medical evaluation to determine whether the
driver is fit to drive again

7
New DUI Laws
Convicted impaired drivers now face more strict
penalties. Police officers now have more power to
determine whether or not a driver is impaired by
drugs or alcohol.

How to Defend A DUI Offence
The first thing your lawyer needs to do is study
the evidence collected against you and watch out
for loopholes to make it difficult for the Crown
to present a fully competent case at trial.
Studying whether or not all the sections under
your Charter Rights were strictly adhered to when
you were charged with the DUI can be a good
start.
