Texas law uses the system of compensatory
negligence. This means that any plaintiff
involved in an accident, no matter how severe,
could be analyzed to determine what percentage of
the accident was their own fault. If their fault
is judged to be greater than 50, then the
plaintiff may not collect any legal compensation
whatsoever. Meanwhile, the truck is quite
possibly owned and operated by a trucking
company, and this company may employ an attorney
to advocate their side as a matter of course.
This means that almost always the only way the
injured individual can be certain of adequate
funds for medical bills and property replacement
is to take an active legal course.
