  • Employment law is subject to constant changes
    just like any other branch of the legal system in
    the UK.
  • The days of the nasty mill owner firing people at
    will just because he was having a bad day at
    home, is long past. The Trade Unions and perhaps
    the suffragette movement that strived for equal
    rights and pay for women finally won through.
  • Although, come to think of it, the last part
    about equal pay for women rather surprisingly is
    still not entirely true in all professions.
  • Anyway, firing an employee is no longer
    straightforward especially if the person has
    worked continuously full time for more than the
    magic threshold of two years.

  • Before two years has been completed it is much
    easier for the employer to let a person go
    although even then they must be clear of the
    reasons.
  • When someone loses their job their biggest worry
    is bound to be a lack of income. With limited
    savings they become reluctant to visit a lawyer
    to check whether they have been fairly and
    legally fired.
  • But it costs nothing to walk into a solicitors
    practice and ask to see an employment specialist
    for an opinion as to whether there is a case to
    be made.

  • Many people are timid about seeing a solicitor
    just as they are about visiting their doctor or
    dentist. But believe me, of those three the one
    you should be most concerned about is the
    dentist.
  • Theres a reason for solicitors practices to be
    located prominently on the high street in towns
    and not on some cheaper out of town site. Its
    simply that this is their best chance to entice
    local people through the door.
  • The initial visit on any matter is always without
    any cost and if the visit concerns someone
    feeling they have been unfairly dismissed from
    their job there is an added bonus.

  • Most practices have no win no fee employment
    solicitors. They realise that having lost your
    job you may not have the funds to take legal
    action.
  • So if the solicitor listens carefully to all the
    details and agrees a person has been unfairly
    dismissed they can go into action at no cost to
    the client. And only receive payment by way of a
    percentage of the amount they finally get for
    you.
  • Very often an initial letter from the solicitor
    to the employer will result in some settlement
    that may even include the offer of the old job
    back. The employer may have time to reflect on
    the way they dismissed the employee and even take
    counsel from their own solicitor.

  • The last thing any employer wants is to have to
    attend is an employment tribunal as they are
    obliged to do if they dont want to automatically
    have an award made against them.
  • Its also normally very bad publicity for the
    company especially when they lose the battle.
