AB 831 Annual CDE Technical Clean-Up Measure
  • Contains various changes to Williams statutes
    related to
  • County Superintendent oversight authority and
    school visits
  • Eligible schools
  • Classroom Notices and the Uniform Complaint
    Procedures
  • Instructional Materials
  • Teacher Misassignments
  • The measure was signed by the Governor on July
    25, 2005 (Chapter 118)
  • All changes take effect immediately upon enactment

County Superintendents Authority and Visits to
Williams Schools
  • Clarifies that, in general oversight of school
    districts in each county, the county
    superintendent shall enforce the use of state
    textbooks and instructional materials regularly
    adopted by the school board (in accordance with
    Education Code Section 51050)
  • Authorizes County Superintendents in a county
    with more than 200 Williams eligible schools to
    use a combination of teacher surveys and visits
    to determine the sufficiency of instructional
    materials
  • Specifies that changes to the statute become
    effective in the 2005-06 school year

Change in the Definition of Williams-Eligible
Schools
  • Contains language to eliminate county-operated
    special education programs from the list of
    schools ranked in deciles 1-3 on the 2003 base
    Academic Performance Index (API)
  • NOTE CDE is concerned that the language is
    overly broad and may exclude some comprehensive
    high schools that were intended to be included in
    the Williams settlement
  • Expect additional legislative action on this
    issue, but CDE agrees with objective to exclude
    COE programs

Classroom Notices and Uniform Complaint Procedures
  • Specifies that classroom notices, which are
    required to be posted in EVERY classroom in the
    state, must include teacher vacancies and
    misassignments
  • NOTE although the original Williams
    legislation specified that parents could
    file a Uniform Complaint regarding teacher
    issues, the statute failed to include them on the
    required classroom notice
  • Modifies notice to conform to instructional
    materials changes e.g. students must have access
    to materials in class and to take home

Instructional Materials Changes
  • Clarifies that textbooks and instructional
    materials adopted by governing boards must be
    aligned to the state content standards in math,
    science, history-social science and
    English/language arts
  • Requires governing boards which declare an
    insufficiency in instructional materials to
    specify the percentage of students who lack
    sufficient materials
  • Specifies that sufficiency of instructional
    materials is defined as providing a textbook or
    instructional material for each student to use in
    class AND to take home
  • NOTE The practical effect of this change is to
    eliminate district/schools ability to use class
    sets of materials
  • Clarifies that 138M appropriated in 04/05 may
    ONLY be used to purchase instructional materials
    for schools in deciles 1 and 2

Teacher Misassignments Monitoring
  • If the annual review finds that a Decile 1-3
    school has no teacher misassignments or teacher
    vacancies, the next review of that school is
    conducted with all other schools on a 4-year
    cycle
  • NOTE The practical effect of this change is to
    potentially eliminate annual reviews of some
    Decile 1-3 schools if they have a clean review
