  • A person can be convicted in NJ if the following
    is proved.
  • The person was operating the vehicle with a blood
    alcohol concentration (BAC) of .08 or more.
  • Done by Breathalyzer or blood reading.

    influence of alcohol by observation.

  • Incarceration up to 30 days
  • Loss of License 3 months
