• A person can be convicted in NJ if the following
  is proved.
• The person was operating the vehicle with a blood
  alcohol concentration (BAC) of .08 or more.
• Done by Breathalyzer or blood reading.

• The person was operating a vehicle under the
  influence of alcohol by observation.
• Poor Performance
• Balance Testing
• Swaying
• Staggering
• Slurred Speech

• First Offense of BAC level .08 and under .10
  are the following
• 250-400 Fines
• Incarceration up to 30 days
• Loss of License 3 months
• NJ DMV Surcharge 1,000 per year x 3 years
• Other fines up to 1,000

• First offence of BAC of .10 or higher are the
  following
• 300-500 fines
• Incarceration up to 30 days
• Loss of License 7-12 months
• Ignition interlock device ?

• Incarceration of higher number of days
• Loss of license for up to 10 years

• Beer is the drink of choice in most cases of
  heavy drinking, binge drinking, drunk driving and
  underage drinking.
• 159 million alcohol impaired driving trips were
  reported in 2002.
