I. 4 Principles of the Constitution
  • A. Popular Sovereignty
  • 1. the govt gets its power from the consent of
    the governed
  • 2. practiced through elections

  • B. Limited Government (from Magna Carta)
  • 1. anything that limits the power of govt
  • a. Ex Bill of Rights
  • b. Ex Denied Powers
  • C. Separation of Powers
  • 1. divides govt powers between 3 branches (LEJ)
  • 2. use checks and balances to prevent any one
    branch from getting too much power
  • a. Ex veto when the President rejects a bill
    by Congress (executive Checking legislative)
  • b. Ex override Congress can overturn
    Presidents veto with 2/3 vote (legislative
    Checking executive)

D. Federalism
  • A. dividing powers between state and federal
    govt
  • 1. Enumerated (expressed) powers powers
    written in the Constitution given to federal
    govt (war, military, money)
  • 2. Implied powers powers given to federal
    govt NOT WRITTEN in the Constitution (Necessary
    and Proper Clause)
  • 3. Reserved Powers anything not in the
    Constitution is reserved for states (education,
    marriage, drivers license)
  • 4. Concurrent Powers powers shared between
    state and federal govt (taxes and courts)
  • 5. Denied Powers things that NO level of
    govt can do (ex post facto, writ of habeus
    corpus, bill of attainder)
