E-Citations
  • Electronic systems provide a quantifiable
    financial benefit by removing clerical data entry
    requirements, improving officer efficiency and
    safety, and increasing revenue by producing more
    accurate, enforceable citations.

Law Enforcement E-Citation Usage
  • The data indicates law enforcement agencies
    (LEAs) are increasingly using computer generated
    citations created by mobile laptops or hand held
    devices.
  • Today, 54.6 of law Enforcement agencies are
    using or preparing to use e-citations.
  • This percentage has increased exponentially as
    the total number of LEAs using e-citations has
  • increased.

Paperless Pilot
  • As of September 1, 2010, the drivers signature
    is no longer required on the Uniform Traffic
    Citation unless the offense requires a mandatory
    hearing.
  • The Department conducted a paperless citation
    pilot with Marion and Alachua counties to receive
    and process electronic citation data directly
    from Florida Highway Patrol
  • Paperless Pilot helped to establish best practices

  • The use of E-Citations aids in the reduction of
    commonly occurring errors
  • Legibility
  • Incorrect Statute Numbers
  • Incorrect Driver License Numbers
  • Incorrect DL class or failure to indicate
    CDL/Commercial Vehicle
  • Incorrect date of birth
  • Incorrect spelling of violators name
  • Incorrect traffic light and speeding amounts
  • Citations filed in an untimely manner
  • Incorrect amount for Fix-It tickets
  • Incorrect amounts for registration, Driver
    License and insurance tickets

Barriers to Judges Accepting E-Citations
  • Judges would like to have a replica (or
    electronic image) of the electronic ticket that
    they can see in court that presents the
    information in the same format as a standard
    paper ticket.
  • The non-transmission of data in the Officer
    certify check box by the FHP electronic citation
    system.  
  • Judges will not/ do not like accepting citations
    that do not contain the violators signature.

New Numbering System
In October 2011 the Department will employ its
new inventory system and implement a new
numbering sequence. The new sequence will remain
a 7 character number. Characters 1-6 are a
collection of alpha-numeric characters generated
by a base 36 conversion. The seventh character
will be either P for paper or E for
electronic. Electronic numbers will be delivered
in an excel spreadsheet in an effort to reduce
duplication errors

  • A Long Form Report (HSMV 90010S) in its entirety
    must include a Narrative, Diagram and any
    necessary Update Report form (HSMV 90010S) when
    the following criteria are met
  • Death or personal injury
  • Leaving the scene involving damage to attended
    vehicles or property (F.S. 316.061 (1))
  • Driving while under the influence (F.S. 316.193)
  • The Short Form Report (HSMV 90010S) designation
    is used to report other types of traffic crashes.
  • If form HSMV 90010S is used as a Short Form, the
    officer who investigates the traffic crash is
    only required to fill in the shaded areas.

316.066 , F.S. (1)  The driver of a vehicle which
is in any manner involved in a crash resulting in
bodily injury to or death of any person or damage
to any vehicle or other property in an apparent
amount of at least 500 shall, within 10 days
after the crash, forward a written report of such
crash to the department or traffic records
center. However, when the investigating officer
has made a written report of the crash pursuant
to subsection (3), no written report need be
forwarded to the department or traffic records
center by the driver.

Retention Requirements
GS2 Law Enforcement
  • The retention is for the copy retained by the
    reporting agency, not for the copy received by
    the Department of Highway Safety and Motor
    Vehicles
  • Record Copy 180 days
  • Duplicates Retain until obsolete, superseded, or
    administrative value is lost
  • Short forms 4 years

Crash Report Sales Public Records Information
  • Section 316.066, Florida Statutes, "Written
    reports of crashes", governs the completion and
    subsequent distribution of traffic crash reports.
    Traffic crash reports are exempt from public
    disclosure for 60 days after the date the report
    is filed, except for parties involved in the
    crash and other specific parties outlined in the
    statute. This statute also provides criminal
    penalties (third degree felony) for the unlawful
    disclosure of confidential personal information
    and for unlawfully obtaining or attempting to
    obtain confidential personal information.
