to create the right material that is set out in
    the book II BW

    right held by the property"

  • The right material (zakelijke rechten)rights who
give to person, which provides direct control
over a thing, which can be maintained against any
    person.
  • The right materialgt ltRights of individuals

  • Rights that can only be defended against certain
people. Ex right to claim / billing to someone.

8
According BW
  • The division of "Objects"A. - Tangible
    objects  - intangible objects B. - Move
object   - The object is not moving

9
Moveable thing
  • A. because of itsObjects can be moved without
    changing its shape.
  • B. Since the establishment of the LawObjects
defined by law as a moving object (usually a
right that can be transferred the duty)

10
  • Objects do not move
  • Because of its. Ex soil
  • Since the purpose of usage. Ex machinery factory
  • Because the Act. Ex right erfpachtRules on the
Law of objects related to the issue of
land according to the book II BW is no longer
valid with replaced by Law No. 5/60 (BAL)

11
Case
  • A male or female, not married when they have full
rights and obligations. Rights and obligations
relating to the life, rights and obligations and
so will his property. Then after they engage
in the institution of marriage, then
it started right then that they become a liability
. Understanding into one that does not mean the
rights and obligations of each party will merge, b
ut their rights and obligations remain intact even
though they have been united in life. For
that they must understand and respect each other.
feel one of their most meritorious and
others boarded. One does not feel as
other authorities and become a slave, do not

12
Solution
  • Understanding of the rights and obligations are
very important and fundamental , if we
examine more deeply about the consequences of
marriage, because in marriage, will give birth to
    the rights and obligations, among
others, on child rights and obligations of
the property. Even then the possibility
of division of property when the marriage broke
up either because of divorce or the death.

13
Solution
  • We can take some guidance to resolve the
    referenceChapter VII of Property in
    MarriageArticle 35Article 36Article 36CHAPTER
    V Marriage AgreementArticle 29
