Emissions Permits
  • Permits are required for all qualifying
    installations undertaking specified activities
    that emit specified greenhouse gases
  • Installations are stationary technical units
    where specified activities are undertaken
  • Specified activities are detailed in Schedule 1
    of the ETS Regulations
  • Specified greenhouse gases are currently
    restricted to Carbon Dioxide (CO2)

Specified Activities
  • Applications must include details of all relevant
    activities as listed in Schedule 1 of the ETS
    Regulations
  • Applications must also include details of any
    directly associated activities
  • For offshore installations, the only relevant
    activities are combustion installations with an
    aggregated thermal input of greater than 20
    MW(th)
  • For offshore installations, there are currently
    no directly associated activities

Relationship to PPC Regulations
  • Installations may require to be permitted under
    both the ETS Regulations and the Offshore
    Combustion Installations (Prevention and Control
    of Pollution) Regulations 2001 (PPC)
  • The threshold for PPC is greater than 50 MW(th),
    the threshold for ETS is greater than 20 MW(th)
  • Operators who already hold, or have applied for,
    a PPC permit must still apply for an ETS permit.

Completing the Application Form
  • Type of application
  • The application form can be used to apply for a
    new permit, or to apply for a variation to an
    existing permit
  • The type of application must be confirmed
  • Applicant
  • In most cases the Applicant will be the Licensed
    Operator
  • The Applicant may also be a Contractor employed
    to operate the facility on behalf of the Licensed
    Operator
  • If the Applicant is a Contractor, the Licensed
    Operator will be required to confirm that the
    Contractor is authorised to submit the
    application on their behalf

  • Licensed Operator
  • The Licensed Operator will be the company that
    holds the production licence for the installation
    that is the subject of the application
  • If the Applicant is not the Licensed Operator,
    the named contact should be able to confirm that
    the Contractor is authorised to submit the
    application on behalf of the Licensed Operator
  • Invoicee
  • There is a 530 application fee
  • The Department will issue an invoice for the
    application fee, and for subsequent maintenance,
    variation, transfer or surrender fees

  • Installation / Facility Details
  • Name or identifier of installation / facility
  • Type of installation / facility (e.g. FSU, FPSO,
    NUI, Platform etc)
  • Location of installation / facility (quadrant and
    block number, and latitude and longitude
    co-ordinates)
  • Details of any tied-back installations /
    facilities
  • Name of operator of installation / facility (if
    different from Licensed Operator)
  • Description of Schedule 1 activities (list of
    combustion plant, with gross rated thermal input
    and description of emission points)
  • Description of directly associated activities
    (n/a should be entered for offshore installation
    / facilities)
  • Details of fuels used
  • Existing PPC permit details

  • Monitoring and Reporting
  • Emissions must be monitored on the basis of
    either calculation or measurement, in accordance
    with Commission Guidelines
  • Emissions must be reported to the Department (the
    Regulator)
  • Applications must include an outline of the
    planned monitoring and reporting measures
  • It will be a condition of the permit that the
    holder submits a detailed plan to the Department,
    setting out the proposed monitoring and reporting
    measures
  • The permit holder will be required to monitor and
    report emissions in accordance with that plan,
    with effect from 1 January 2005

  • Non-Technical Summary
  • Applications must include a non-technical summary
    of the installation / facility details
  • Where possible the summary should be less than
    300 words

Submission of Applications
  • All sections of the application form must be
    completed
  • Completed forms should be submitted
    electronically to environmentalmanagementteam_at_dti.
    gsi.gov.uk
  • Completed forms should be accompanied by any
    supporting documents
  • Allowance has been made for submission of hard
    copies of applications, or hard copies of
    supporting documents

Submission of Applications (2)
  • Permit applications must be submitted by 31
    January 2004, to allow permit issue by 31 March
    2004
  • Operators that do not have a permit by 31 March
    2004 will not be included in the National
    Allocation Plan (NAP) notified to the European
    Commission
  • Operators that do not have a permit by 31 March
    2004 will be regarded as late entrants, and may
    be accommodated from a set-aside (still to be
    confirmed)

The Permit
  • The permit will consist of three parts
  • Confirmation of grant of permit
  • The permit document
  • The schedule of permit conditions
  • The confirmation and permit will name the
    operator (permit holder) and the installation,
    and will contain a unique permit reference number
  • The reference number should be quoted on all
    correspondence relating to the permit.

Permit Conditions
  • The conditions will specify the Schedule 1
    activities covered by the permit, and any
    directly associated activities covered by the
    permit
  • The conditions will specify the emissions of
    greenhouse gases that are covered by the permit
    and the relevant emissions points
  • The conditions will place an obligation on the
    holder to submit a detailed monitoring and
    reporting plan, confirming the monitoring and
    reporting arrangements that will be implemented
    from 1 January 2005

Permit Conditions (2)
  • The conditions will specify the reporting
    requirements, including reference to independent
    verification of the reports
  • The conditions will require surrender of
    greenhouse gas emission allowances equal to the
    total reported emissions in the preceding
    calendar year (plus any outstanding allowances
    for previous calendar years)
  • The conditions will retain a requirement to
    report the breakdown or malfunction of any
    monitoring or reporting equipment
