Minister of National Defence has said ...
  • The incidents reported are disturbing. The
    conduct, behaviour and attitudes are disgusting
    and unacceptable. They are counter to the core
    values of Canadians including those of the men
    and women of the Canadian Forces. This type of
    conduct also undermines the morale, discipline
    and cohesion that is vital to the success of any
    military unit.

    Canadian Forces where women and men can work
    safely, side-by-side, in a climate of dignity and
    mutual respect, free from harassment and abuse

Sexual Assault
  • Component 1 - Assault
  • A person commits Assault when
  • Without the consent of another person, a person
    applies force intentionally to that other person,
    directly or indirectly
  • A person attempts or threatens, by an act or
    gesture, to apply force to another person, if the
    person has, or causes that other person to
    believe on reasonable grounds that they have the
    present ability to effect their purpose or
  • While openly wearing or carrying a weapon or an
    imitation thereof, a person accosts or impedes
    another person or begs.

  • Circumstances pointing to assault of a sexual
    nature

    words, gestures or threats accompanying the act

    including the purpose of the attacker.

  • The agreement is expressed by the words or
    conduct of a person other than the complainant
  • The complainant is incapable of consenting to the
    activity
  • The accused induces the complainant to engage in
    the activity by abusing a position of trust,
    power or authority

    lack of agreement to engage in the activity or
  • The complainant, having consented to engage in
    sexual activity, expresses, by words or conduct,
    a lack of agreement to continue to engage in the
    activity.

Sexual Misconduct
  • Definition
  • An act which has a sexual purpose or is of a

    Criminal Code or the Code of Service Discipline.

  • Sexual Assault (no weapon or bodily harm) - 10
    years imprisonment.
  • Sexual Assault involving a weapon, threats to
    third party, or bodily harm to complainant - 14
    years imprisonment and minimum 4 years
    imprisonment if firearm used.

  • Aggravated Sexual Assault - life imprisonment and
    minimum of 4 years imprisonment if firearm is
    used.

  • Become familiar with, observe and enforce the
    NDA, the QRO and all other regulations, rules,
    orders and instructions.
  • Promote the welfare, efficiency and good
    discipline of all subordinates.
  • Report to the proper authority any infringement
    of the pertinent statutes, regulations, rules,
    orders and instructions governing the conduct of
    anyone subject to Code of Service Discipline.

    matter to Military Police for investigation.
  • Possible offence under the Code of Service

    inquiry or military police.
