Title I NCLB Requirements of Districts with
Schools in Step 1
  • Schools in this category have not made AYP for
    two consecutive years in same subject or other
    indicator and are considered to be in Step One
    of school improvement.
  • Schools must notify the families of enrolled
    students (no later than the first day start of
    school) about the opportunity to transfer their
    student to another school in the same district
    that is not identified for school improvement.

  • Districts must use an amount equivalent to 20 of
    their Title I, Part A budget (unless a lesser
    amount is needed) to fund public school choice.
    Transportation costs (within federal parameters)
    must be covered by the district for families
    exercising this option.
  • Schools must set aside 10 of their Title I funds
    for professional development.

  • Schools must develop or revise their School
    Improvement Plan no later than three months after
    the school is identified for school improvement.
    The plan must cover a two year period. Guidance
    for the letter and the school improvement plan
    are in the USED LEA and School Improvement
    Non-Regulatory Guidance at http//www.ed.gov/progr
    ams/titleiparta/legislation.htm.
  • The plan must be reviewed and approved by the
    district within 45 days, and implemented no later
    than the beginning of the next school year.

  • Schools in Step 2 must implement the school
    improvement plan and adjust based on new student
    achievement data.
  • Districts must continue to offer public school
    choice and must also provide supplemental
    educational services (SES) to low-income
    students. (i.e., students who qualify for
    free/reduced lunch).

  • Districts must inform parents (through a letter)
    to their right to select an SES provider and
    provide parents a list of SES providers from
    OSPIs state approved list of SES providers. (The
    approved providers list is available at
    http//www.k12.wa.us.ESEA/AdequateYearlyProgress.a
    spx.) The district must ensure that all eligible
    students are offered SES.
  • Districts must use an amount equivalent to 20 of
    their Title I budget (unless a lesser amount is
    needed) to fund public school choice and
    supplemental services. Parents of students from
    Title I schools may only select one of these two
    options Public school choice or SES.

New Title I Regulations for Districts with
Schools in Improvement
  • School districts are required to notify parents
    of their option to transfer their child to
    another public school not identified for
    improvement and provide details about the
    available options no later than 14 days before
    the start of the school year. (Public School
    Choice)
  • School districts are required to post information
    on the implementation of public school choice and
    supplemental education services (SES) on their
    web site.

New Regulations (continued)
  • School districts are permitted to count costs of
    parent outreach and assistance toward meeting
    their 20 percent obligation but districts are
    required to demonstrate that parents of eligible
    students have a genuine opportunity to transfer
    their child to another school or to obtain SES
    before a district may use any unspent funds from
    its 20 percent obligation for other allowable
    activities.

  • School districts are required to identify a
    school as in need of improvement if the school
    does not meet the Annual Measurable Objective
    (AMO) in the same subject (or meet the same
    academic indicator) for two consecutive years.
  • A district may not limit identification for
    improvement to schools that miss AYP only because
    they did not meet the AMO in the
  • same subject (or meet the same academic
    indicator)
