• Established in 1961, has three main functions as
  follows
• 1. Carrying out state management on plant
  protection work .
• 2. Implementing state management on plant
  quarantine activities .
• 3. Performing state management on pesticide .

  activities.

PLANT QUARANTINE LEGISLATION

• Ordinance on Plant Protection and Quarantine was
  approved by standing committee of the National
  Assembly on 25 july 2002.
• Decree No. 58 of The Vietnamese government was
  enacted by 03 June 2002
• Decision No. 84
• Decision No. 89
• Decision No. 117
• Under these above legal document, in 2002, there
  were 6 plant quarantine procedures established
  for plant quarantine work.

Phytosanitary restrictions, requirements and
prohibitions

• Regarding phytosanitary restriction, requirement
  and prohibitions, Vietnam really not yet comply
  this principle so far. Due to following reasons
• The legal document system of Vietnam are not
  regulated this issues, so that Vietnam need to
  supplement in normative document in the near
  future.
• Vietnam is not yet a contracting party of IPPC
  so far Therefore, this obligation is not
  compulsory for Vietnam to inform new
  phytosanitary measures to other countries.

Points of entry with specific restriction

• According to Article VII 2(d), Vietnam
  completely complied this regulation without
  specific restriction. So far, Vietnam established
  a list of points of entry at land border,
  international airport and sea port . (43 check
  points).
• Vietnam also informed this list to other
  countries concerned.
• All phytosanitary activities is performed at
  these entry of point according to Vietnam
  regulations

Pest report

• Annually, Vietnam has the surveillance of growing
  plant and plant products in storage with purpose
  of detecting and reporting the occurrence,
  outbreak or spread of pests. In order to carry
  out this work effectively, there are articles in
  Ordinance on plant protection and quarantine of
  Vietnam stipulated clearly ( Chapter II, Article
  9,10,11 and 12).
• In addition, other regulations relating to pest
  report are also mentioned by Regulation on plant
  protection and bilateral agreements between
  Vietnam and other countries.
• All pest report were recorded and stored in Plant
  Protection Department as NPPO

List of regulated pests

• Periodically, the Minister of Agriculture and
  Rural Development shall evaluate and publish the
  list of plant quarantine pests that must be
  prevented from entering Vietnam or spreading
  within the country (Ordinance on plant protection
  and quarantine, chapter III, Article 15)
• The current list of plant quarantine pests of
  Vietnam is published by Minister of MARD with 61
  pests (in 2000).
• However, up to now, Vietnam is not yet developed
  any list of regulated non quarantine pest of
  Vietnam.

Emergency actions

• Following the current legal documents of Vietnam,
  there are some action will be applied in
  emergency cases, specific as below
• Shall not be imported,
• Shall be returned to the place of origin
• Or destroyed
• Treatments
• The above action taken will be notified to
  contracting party concerned.
