How Are Pain and Suffering Damages Calculated in
a Car Accident Claim?
2
If you happen to find yourself recovering from a
car accident, you may want to consider filing a
claim. It is a complicated process, one that
included many different calculations in order to
determine the final value you will receive.
After a car accident, your life will change
entirely. You will have to deal with many
different things, and adjust to the new life.
They encourage you to speak with one of the car
accident lawyers in Los Angeles and have them
help you file a claim. They will protect your
best interests, and help you receive the highest
amount possible.

When calculating the total value of your claim,
attorneys tend to struggle with the calculations
involving pain and suffering. It is never easy to
determine the value you are owed for all the pain
and suffering you endured during your recovery.
4
Heres How It Is Calculated In Most Cases.
Per Diem
  • Many attorneys use the per day method when
calculating the total value of your claim. When
it comes to pain and suffering, one can never be
sure how to properly calculate the amount. Heres
    how this method works

5
  • An amount of money is assigned to each day or
week that you suffer after receiving an injury
  • This amount is multiplied by the number of days
you were unable to resume working
  • A total amount is calculated

One small problem occurs, and that is the daily
assigned amount. To determine this factor, the
attorneys use your daily income. They will go
through your weekly reports and find a daily
income based on the reports for the last 6
months. For example, if your daily income is
100, and you werent able to work for 2 months,
they will multiply 100 by 60 or 61 days, and give
you a total value you are going to receive.
6
Multiplier Method
  • This method is a bit more complicated than the
per day method. In the past, many attorneys would
take the actual damage (your lost wages medical
bills) and multiply it by 3 in order to reach a
    reasonable amount.
  • Nowadays, not everything can be multiplied by 3.
    Instead, Insurance companies have developed
several different calculation software. They no
longer automatically accept that 3 is a
reasonable multiplier for pain and suffering. Now
they have different multipliers for different
    types of injuries.

Light injuries carry multipliers 1 and 2, while
serious injuries can carry a multiplier of 3 and
4. Car accidents can have any multiplier from 1
to 4, depending on the severity of the injury.
The only way to know for sure is to speak with
the Los Angeles car accident attorneys.

The Final Value
The best way to receive the right amount is to
use both methods when calculating your total car
accident claim. Never set your expectations too
high, but try to be more realistic. When setting
your expectations, include things such as your
medical bills, how long were you out of work, the
severity of your personal injury, and whether or
not others were involved. Together, these factors
will help you draft a reasonable value for your
claim.
