  • GASB 40 Disclosures
  • Notes must say clearly if no formal policy
  • Including custodial credit risk for deposits
  • No policy statement implies Board approval
  • A statement is only required if the risk exists
  • Avoid negative disclosures
  • e.g. If no custodial credit risk at the category
    C(3) level then no need to include a discussion
    on your policy of using third party safekeeping
  • Concentration of credit risk be sure to include
    when applicable

    relevant investment risks had to be disclosed

  • Formally adopted policy had to be disclosed
    relevant to each specific risk
  • Formally adopted Board approved

  • Several different scenarios
  • Board approved policies modeled after the
    examples in the Policies Manual that dont
    address all the risks
  • Internal policy/procedures not Board approved
  • Whether Board approved is units discretion
  • If no formal policy to address the specific risk,
    notes must say that the unit has no formal policy
  • GASB has confirmed that the unit can also
    disclose a brief statement regarding the
    procedure or management practices that help
    manage or mitigate the risk

  • Credit risk

  • Fund Balance Appropriated
  • Look primarily at two things
  • What was appropriated for year under audit
  • What is being appropriated for next year
  • Can never appropriate more than what was
    available at end of prior fiscal year
  • This applies to all funds, not just General Fund
  • Should not have fund balance appropriated as a
    revenue source in a multi-year project budget

  • Effective for year ending December 15, 2006 or
    later
  • New terminology
  • Significant deficiency instead of reportable
    condition
  • Material weakness
  • Communication must be in writing
  • Must be no later than 60 days after release date
    of report

  • As long as significant deficiencies and material
    weaknesses exist they must be reported
  • Drafting of financial statements does not
    automatically result in a material weakness
  • May be result of a control deficiency
  • Deficiency exists if client does not have control
    over preparation of statements and disclosures
    that would prevent or detect a misstatement

    not stop at general ledger but includes controls
    over preparation of the financial statements

  • Control deficiency
  • Exists when design or operation of a control does
    not allow management or employees in the normal
    course of performing their assigned duties to
    prevent or detect misstatements on a timely basis
  • Significant deficiency is control deficiency from
    which there is more than a remote likelihood that
    that a misstatement of the financial statements
    that is more than inconsequential will not be
    prevented or detected

  • Significant deficiency or combination of
    deficiencies that result in more than a remote
    likelihood that a material misstatement of the
    financial statements will not be prevented or
    detected
  • Remote when it is at least possible
  • More than inconsequential magnitude of

  • Financial statement amounts or total of
    transactions exposed to the deficiency
  • Volume of activity in the account balance or

    federal programs

    process

  • Reporting of profit or loss by worker as a result
    of services rendered indication of 1099 reporting
  • Advertising service to general public indicates
    1099 reporting

  • Worker required to comply with other persons
    instructions with regards to when, where and how
    indicates W-2 reporting
  • If employer provides training for worker,
    indicates W-2 reporting

  • Must be on W-2 not on 1099 Misc
  • Must have FICA taxes withheld and paid
  • Emergency worker exclusion does not apply
  • IRS regulation
  • Can pay funds to VFD if VFD is incorporated,
    then no reporting by local government required
  • Can pay firemen under accountable plan

  • Tax Increase Prevention and Reconciliation Act of
    2005 (TIPRA) now requires 1099-INT filing for
    tax-exempt interest, starting with calendar year
    2006
  • New Box 8 on 1099 INT for tax-exempt interest

  • Most local governments wont have to report
  • Interest paid through DTC will be reported by DTC
    to payees
  • Interest payments to corporations, other
    tax-exempt organizations, and financial
    institutions not reportable
  • If unit is paying interest directly to
    individual, partnership, limited liability
    companies taxed as partnerships, or
    S-corporations, reporting is required, typically
    for real estate purchase

  • Substitute forms permitted for 2006 only
  • 1099 must be furnished to payee by January 31, to
    IRS by February 28 (paper or magnetic) or March
    31 (electronic) beginning with 2007
  • No penalties assessed for 2006
  • Backup withholding required beginning in 2007 if
    dont have TIN of payee
  • See IRS Notice 2006-93

  • Continuing to work on guidance
  • Component units implement same time as primary
    governments
  • Having a study doesnt require implementation
  • Once study is complete, must disclose results in
    any official statements subsequently issued
  • Encourage all units to have at least initial
    valuation

  • Legislation
  • Have met with various local governments, NCLM,
    and the Association
  • Believe that legislation will be introduced to
    allow investment of OPEB funds with DST
  • Will allow units that decide to fund and invest
    to use a higher ROR in calculations
  • Working with NCACPA on issues of investment,
    administration and reporting

  • Envision these investments to be funds not needed
    in short-term
  • Should be that portion of funding that will go
    towards benefits paid in future
  • Working on disbursement of funds on a
    reimbursement basis

  • State funds may not be available in future to
    units that have opportunity to buy insurance and
    choose not to do so
