Title: Industrys Need for Rulemaking Harmonization: Supporting the Future Global Air Transportation System

1
Industrys Need for Rulemaking Harmonization
Supporting the Future Global Air Transportation
System
2
Major Discussion Points
  • Industry and Operators support future
    harmonization which serves all stakeholders
  • There must be consistency of intent on the rules
    not necessarily identical language
  • Continual commitment and communication needed
    between authorities and industry

3
Major Discussion Points
  • Harmonization must be a top down, managed process
  • Harmonization leads to interoperability which
    promotes compliance assurance and efficiency
  • Harmonization priorities for operators and
    manufacturers were discussed.

4
Response from the Authorities
  • Authorities have established rulemaking
cooperation initiatives and continue to improve
    those efforts
  • Authorities agreed to find a way to involve
    industry
  • Harmonization is a tool but not the only one to
achieve higher safety objectives and free
circulation of products, services, and people.

5
Response from the Authorities
  • Restated their commitment to reduce differences
    when possible
  • Agreed with the need to focus on the intent of
the regulations rather than having the same
    language
  • Working to refocus their efforts in accordance
with SMS principles and the need to use limited
    resources efficiently

6
Reaction from the Floor
  • ICAO asked FAA and EASA to feed key initiatives
    into the ICAO work program
  • Do we really need to harmonize since there will
always be different interpretations of the rules?
  • Harmonization is not the end objective it is
    the foundation and framework

7
Reaction from the Floor
  • FAA cannot strictly establish mutual recognition.
EASA pointed out that mutual recognition is a
    general EU principle.
  • Harmonization has worked well in the past but its
full benefits have not been achieved in the field
    (e.g. multiple auditors).
  • Inquiry regarding future worldwide code.
  • FAA, EASA, TCCA should work as a team to promote
harmonized rules with the developing world.

8
Proposed Actions
  • FAA and EASA should brief ICAO on rulemaking
    initiatives.
  • There is a need to establish an effective
harmonization management framework in the context
    of the FAA/EASA/TCCA bilaterals.
