Tech Transfer Bayh-Dole Act
The Bayh-Dole Act allows for the transfer of
exclusive control over many government funded
inventions to universities and businesses
operating with federal contracts for the purpose
of further development and commercialization. The
contracting universities and businesses are then
permitted to exclusively license the inventions
to other parties. The federal government,
however, retains "March-in" rights to license the
invention to a third party, without the consent
of the patent holder or original licensee, where
it determines the invention is not being made
available to the public on a reasonable basis,
(in other words, to issue a compulsory license.)
  • 1970s, US industry in decline/reversal required
  • 28,000 Govt patents but only 5 licensed
  • 1980 Bayh-Dole Act Passed
  • Enables universities to elect title to inventions
    made with federal funding.

Hospitals to Cope Creatively By LAURIE TARKAN
anter in the hospital operating room may be
less lively if the surgeon's assistant is a robot
rather than a nurse, but that is of no concern to
the inventor of Penelope. With a six-year-old
nursing shortage showing no signs of easing, Dr.
Michael R. Treat of the Columbia-Presbyterian
Center in Manhattan is hoping that his one-armed
robot will replace the nurse who hands the
surgeon the instruments, freeing the nurse to
give postoperative care.

Penelope listens to the surgeons voice, and
hands off the requested instrument. When the
surgeon is finished with the instrument, the
robot uses the camera to locate and retrieve it.
