Why file a US income tax report or return?
  • It is the law.
  • If you have had more tax withheld than you owe,
    you can get a refund.
  • If you apply for permanent residency sometime in
    the future, you will have to file for all the
    years you missed and pay interest on any tax you
    owed.

This is for F-1 students only
  • Are you a resident or non-resident for tax
    purposes?
  • Have you been in the US for 5 years or less?
  • Any part of a year counts as a year.
  • Do you have an identifying number?
  • If you have a Social Security number (SSN), that
    is your identifying number.

  • If you dont have a SSN, you need to get an
    Individual Taxpayer Identification Number by
    filling out Form W-7. You will send in a package
    including
  • Form 8843
  • Form 1040NR-EZ or 1040NR (the income tax return)
  • Form W-7
  • Notarized copy of passport
  • These are sent to the address given on the W-7

  • Proves that you can file as a non-resident
  • Part I F-1
  • Dont fill in 1a to 3b because you are attaching
    it to Form 1040NR-EZ
  • 4 actual number of days. 4b is all the days!

Do you need to file an income tax return? Yes, if
any of the following is true
  • You received a Form W-2
  • You received a Form 1042-S that listed any
    unqualified scholarship money
  • You received a scholarship that covered more than
    tuition and books
  • You had any earned income
  • If no enter your address at the top of the Form
    8843 and sign it at the bottom of page 2, and
    youre done!

Can you file Form 1040NR-EZ? Yes, if all of these
statements are true.
  • No dependents (married nonresidents file
    separately)
  • Cannot be claimed as a dependent on anyone elses
    tax form
  • The only sources of income were wages, salaries,
    tips, taxable refunds of state and local income
    taxes, and scholarship grants. (if you had
    investment income from US sources, you would file
    1040NR.)
  • Taxable income under 50,000
  • The only adjustment to income is student loan
    interest or scholarship exclusion.
  • .

Can you file Form 1040NR-EZ? Yes, if all of these
statements are true (Cont.)
  • No tax credits are claimed
  • No exemption claimed for the spouse
  • The only itemized deduction is state and local
    income tax (if you had charitable contributions,
    you would file 1040NR)
  • The only taxes owed are income tax.

Check to see that you have
  • All 2004 W-2 forms from Shorter or your previous
    school
  • All 1042-S from any school you attended in 2004
  • Any Form 1099 you received
  • Your TIN (if you have one, W-7 if not)
  • If you received a Form 1098-T, it does not apply.
    This is only for US resident taxpayers.

Was your scholarship qualified or unqualified?

  • It is qualified if it is less than or equal to
    the cost of tuition, fees, and books for which
    the money went to the bookstore and not to you
    directly.
  • Evidence
  • Form 1042-S, Code 15 with a dollar amount.
  • If you did not receive a Form 1042-S, you need
    your financial aid award letter that should list
    your financial aid as well as tuition and fees.
    This should be on letterhead.

What are Wages?
  • Wages are money paid to you for work.
  • You should have a Form W-2 that reports your
    wages and the tax that was withheld from them
  • Write the total of all money from all your W-2s
    and any Code 18 or 19 income from Form 1042-S on
    scratch paper.
